How To Remove Article 370?
Lok Sabha, Rajya Sabha, President and, Jammu and Kashmir Assembly have the power to scrap Article 370. It is possible to remove “but” it seems impossible because of the Instrument of Accession.
What Is An Instrument Of Accession?
The instrument of accession is an agreement wherein a state decides to join (accede to) another state.
“The people of this state, through their own Constituent Assembly, would determine the internal Constitution of this state and the nature of the extent of the jurisdiction of the Union of India over the state, and until the decision of the Constituent Assembly of the State, the Constitution of India could only provide an interim arrangement regarding the state”.
So, Article 370 is one of the terms and conditions of the Instrument of Accession.
That means removing Article 370 violates the condition, and Instrument of Accession becomes technically null and void as there is nothing else with India that substances the Accession.
Though Article 370 is a temporary provision. According to clause 3 of Article 370, the President has the right to revoke Article 370 but with the recommendation of Jammu and Kashmir assembly. However, Article 35A of the Jammu and Kashmir makes it a permanent provision.
How Can It Be Removed?
BJP is the only party that wants to remove Article 370. For this, it needs to have a majority alone in Jammu and Kashmir which is highly impossible. However, it had reiterated its stand on Article 370 later.
Why Its Impossible For BJP To Get Majority In J&K?
Kashmir region has 96.4% Muslim, 2.45% Hindus, 0.98% Sikhs, and others 0.17%. Abdullah family made sure that no seats can be won in the Kashmir region without Muslim support. Not to forget the fact that Hindus are murdered.
Caste and religion have become a very sensitive topic. So, we can’t expect much change at least for some more centuries.
