The court deemed the Juvenile Justice Board’s order to put him in an observation home unlawful and unconstitutional. It was made clear that the adolescent is receiving rehabilitation, that a psychologist was sent to him, and that these sessions will go on. The “primary objective” is rehabilitation, the court stated. “The CCL (child in conflict with the law) is under 18. His age needs to be considered,” the court mentioned.

“We are bound by law, the aims and objectives of the Juvenile Justice Act and must treat him as any child in conflict with law separately from the adult, despite the seriousness of the crime,” stated the bench of Justice Bharati Dangre and Justice Manjusha Deshpande.

The boy’s aunt filed a habeas corpus petition to have him released from a government observation home, and the decision was made in response. Due to an attempted cover-up, the teen’s parents and grandfather have been arrested; as a result, his aunt will now be caring for him.

The aunt of the accused is given custody and supervision of the 17-year-old charged in this instance. The court ordered the kid to continue his appointments with the psychologist upon discharge.
