The Salary and Allowances of Leaders of Opposition in Parliament Act, 1977 established the Leader of the Opposition (LoP) as a legislative post in India. The leader of the opposition party with the most members in the Lok Sabha or Rajya Sabha is that person. The role has its origins in the pre-Independence period when notable figures such as Motilal Nehru were honored and rewarded. An important part of the Indian parliamentary democracy is still played by the LoP, whose first leader was Dr. Ram Subhag Singh. He led it from 1969 to 1971.

The LoP is essential to parliamentary processes.  It acts as a check and balance on the governing administration, making sure that different points of view are taken into account and that they are represented. As the Leader of the opposition, Rahul Gandhi holds the opinion to appoint important bureaucrats. He is a member of several selection committees that appoint heads of statutory bodies such as the Lokpal, National Human Rights Commission of India, Central Vigilance Commission, Central Information Commission, and Central Bureau of Investigation.
