On Friday, the Supreme Court granted bail to Delhi Chief Minister Arvind Kejriwal in the excise policy case. He had been in jail for six months. The Enforcement Directorate will now release him following his arrest.

On July 12, the Supreme Court granted interim bail to Arvind Kejriwal in a liquor scam and money laundering case. According to the investigations, the police were manipulated to favor some private liquor companies. It led to certain losses of revenue for the government. The accused, Kejriwal, has denied all allegations against him. He called all the allegations to be politically motivated.

The court decided to give their verdict on September 5 after hearing the counsels who were representing Kejriwal and CBI. At the moment of the hearing, Solicitor General SV Raju, who was appearing for CBI, showed his objection to Kejriwal for not proceeding to the trial court for bail first. The objection was valid as Kejriwal had directly approached the Delhi High Court for bail. Then he moved to the apex court. ED arrested CM Arvind Kejriwal on March 21 and CBI on June 26.

The court says perception also plays an important role, and the CBI has to get rid of the impression of being a caged parrot. They must demonstrate that it is an uncaged parrot. The CBI must be like Caesar’s wife, above suspicion.

Justice Surya Kant said, “No impediment in arresting a person already in custody. We have noted that CBI in their application recorded reasons as to why they deemed it necessary. There is no violation of Section 41A(3) of the Code of Criminal Procedure.”

Justice Ujjal Bhuyan stated, “CBI did not feel the need to arrest him even though he was interrogated in March 2023, and it was only after his ED arrest was stayed that CBI became active and sought custody of Mr. Kejriwal and thus felt no need of arrest for over 22 months. Such action by the CBI raises a serious question on the timing of the arrest, and such an arrest by the CBI was only to frustrate the bail granted in the ED case.”

The objection of the additional solicitor general cannot be accepted that the appellant has to first proceed to the trial court for bail. The process of trial shouldn’t end up becoming a punishment. Late arrest by CBI is not justifiable.

Arvind Kejriwal is commanded to not make any public comments about this particular case and be present for all the hearings before the trial court, or else he will be exempted.

Many politicians congratulated Kejriwal for stepping out of Tihar Jail. While some seemed unhappy with the decision. BJP leader Gaurav Bhatia reacts to Arvind Kejriwal’s bail and says he must resign after a Supreme Court bail order. He quoted ‘jail wala’ CM is now ‘bail wala’ CM.

Whereas, AAP leader Gopal Rai tells ANI, “Congratulations to everyone. Delhi CM is coming out now. There is joy among people.” Delhi minister Atishi posts on platform X, “Satyamev Jayate. The truth can be troubled, not defeated.”
